Masline LLC (hereinafter referred to as the Seller) offers any individual, legal entity or individual entrepreneur (hereinafter referred to as the Buyer) to conclude a contract for the purchase and sale of goods on the following terms.
1. Terms and definitions
1.1. Offer – this document is the "Public Offer Agreement for the sale of goods", published on the Seller's website masline.ru .
1.2. Contract – a purchase and sale agreement between the Seller and the Buyer, concluded by Accepting the Offer.
1.3. Acceptance of the Offer is the complete and unconditional acceptance of the terms of the Offer by the Buyer. Clicking the "Place an order" / "Pay" button on the website is considered acceptance. masline.ru or any other action to place and pay for an Order.
1.4. Product – products presented in the catalog on the website masline.ru
1.5. An Order is an intention made by the Buyer on the Website to purchase the Product under the terms of this Offer.
1.6. The Buyer is the person who accepted the Offer.
1.7. The seller is Masline LLC.
1.8. The Agreement does not require sealing and/or handwritten signature by the parties and has full legal force.
2. Subject of the Agreement
2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to accept and pay for them in accordance with the terms of the Agreement and the prices published on the website. masline.ru .
2.2. The name, quantity, assortment and price of the Product are determined by the Buyer when placing the Order.
2.3. If the Buyer leaves a review about the purchased Product on the Seller's social networks or on the Website, he agrees to publish personal data in the review: first and last name.
2.4. By making the Acceptance, the Buyer confirms that he has read, agrees and fully accepts all the terms of this Agreement.
3. Term of the Agreement
3.1. The Agreement comes into force from the moment of Acceptance of the Offer by the Buyer and is valid until the Parties fully fulfill their obligations under the Agreement.
4. The cost of the Goods and the payment procedure
4.1. The cost of the Product is determined in accordance with the prices published on the website. masline.ru at the time of placing the Order. Prices are indicated in Russian rubles and include VAT (if applicable).
4.2. The Seller has the right to change the prices of Goods without prior notice. Price changes after Order confirmation are not allowed.
4.3. Payment is made in rubles using one of the following methods:
– online payment by bank card or through the Quick Payment System (SBP) on the website masline.ru
- payment in cash or by card upon receipt of the Goods (to the courier or at the pick–up point).
4.4. The Buyer's obligation to pay is considered fulfilled from the moment of receipt of funds to the Seller's current account or at the time of transfer of funds to the courier or the employee of the pick-up point.
4.5. The Seller issues a cash receipt to the Buyer in accordance with Federal Law No. 54–FZ of 05/22/2003.
5. Delivery and pickup
5.1. The Goods are delivered to the address specified by the Buyer when placing the Order. The zones, terms and cost of delivery are indicated on the website masline.ru .
5.2. The delivery time is calculated from the moment of Order confirmation and full payment (when choosing online payment).
5.3. Upon receipt of the Goods, the Buyer is obliged to check its completeness and appearance. If damage or inconsistencies are found, the Buyer has the right to refuse the Goods and/or draw up an appropriate act.
5.4. Pickup is carried out at the address and during the opening hours indicated on the website masline.ru . The product is reserved for the period specified on the website.
5.5. The risk of accidental loss or damage to the Goods passes to the Buyer from the moment of its actual transfer.
6. Rights and obligations
6.1. The Seller undertakes to:
6.1.1. Transfer to the Buyer the Goods of proper quality in a complete set corresponding to the Order.
6.1.2. Provide the Buyer with complete and reliable information about the Product.
6.1.3. To ensure the safety of the Buyer's personal data and their confidentiality.
6.2. The Seller has the right to:
6.2.1. Refuse to execute the Order if the Goods are not in stock, notifying the Buyer within a reasonable time.
6.2.2. To amend this Offer unilaterally by publishing a new version on the Website.
6.3. The Buyer undertakes to:
6.3.1. Provide reliable information when placing an Order.
6.3.2. Pay and accept the Goods in full and on time.
7. Return and exchange of Goods
7.1. The buyer, an individual, has the right to refuse the Product of proper quality within 7 (seven) days from the date of its receipt, if the Product has not been used, its presentation, consumer properties, seals and labels have been preserved, and there is also a document confirming the purchase (clause 4 of art. 26.1 of the Law of the Russian Federation "On Protection of consumer rights").
7.2. The return of Goods of improper quality is carried out in accordance with the Law of the Russian Federation "On Consumer Rights Protection" and the Civil Code of the Russian Federation.
7.3. For a refund or exchange, the Buyer sends a written notification to the Seller's email address specified in Section 10 of this Agreement.
7.4. The Seller has the right to deduct from the refunded amount the cost of the actual costs incurred (delivery), unless otherwise provided by the legislation of the Russian Federation.
7.5. The refund is carried out within 10 (ten) days from the date of receipt of the Goods and the request for a refund in the same way as the payment was made.
8. Processing of personal data
8.1. By placing an Order, the Buyer, an individual, gives the Seller consent to the processing of his personal data in accordance with Federal Law No. 152–FZ dated 27.07.2006 "On Personal Data" in order to fulfill the Contract and deliver the Goods.
8.2. The Seller does not transfer the Buyer's personal data to third parties, except in cases necessary for the performance of the Contract (transport and logistics partners), as well as cases provided for by the legislation of the Russian Federation.
8.3. The Seller's Privacy Policy is posted on the website masline.ru .
9. Dispute resolution
9.1. The Parties will strive to resolve disputes and disagreements arising from the Agreement through negotiations. The claim review period is 30 (thirty) calendar days from the date of its receipt.
9.2. If it is impossible to settle the dispute in a pre-trial manner, it is referred to the court in accordance with the legislation of the Russian Federation. Disputes with individual Buyers are considered in accordance with the Law of the Russian Federation "On Consumer Rights Protection".
